Understanding the 2026 Streamlined Divorce Process

As of January 1, 2026, California has implemented new laws designed to reduce the backlog in family courts and simplify the process for families who have reached an agreement on their divorce issues.

The Traditional Six-Month Waiting Period

California still maintains a mandatory six-month waiting period from the date the responding spouse is served before a marriage can be legally terminated. However, the new 2026 regulations provide a more efficient administrative path for uncontested cases.

New Streamlined Provisions

Under the 2026 updates, the streamlined divorce path is now accessible to a broader range of couples. 

If you and your spouse have reached a complete agreement on all issues, including property, debt, and child custody, our firm can utilize these new protocols to:

  • Bypass mandatory court appearances. In many cases, we can now submit your final Marital Settlement Agreement and all supporting declarations electronically for judicial review without you ever needing to set foot in a courtroom.
  • Simplified financial disclosures. New amendments have simplified the reporting requirements for mid-range estates, allowing for a faster exchange of "Preliminary Declarations of Disclosure" when both parties waive the final disclosure in writing.
  • Faster entry of judgment. While you must still wait six months to change your marital status to "single," the 2026 rules allow the court to enter a judgment on reserved issues much faster, providing you with legal certainty regarding your property and custody rights months ahead of the status termination.
