How California Courts Calculate Spousal Support

California distinguishes between temporary support and long-term support, and the calculation method differs for each. During divorce proceedings, courts typically apply a guideline formula to temporary support orders, which are designed to preserve the financial status quo while the case is pending.

Long-term support requires a more individualized analysis. Under California Family Code Section 4320, courts must weigh a defined set of factors before entering a permanent or post-judgment order, and the judge retains discretion to award support above or below any formula result based on the specific facts of the case.

Factors courts consider under Section 4320 include:

• Each spouse’s earning capacity and marketable skills
• The marital standard of living established during the marriage
• The length of the marriage
• The age and health of both parties
• Contributions one spouse made to the other’s education, training, or career position
• The needs of each party based on the marital standard of living
• Each party’s assets and obligations

Types of Spousal Support Available in California

California courts can order several distinct types of support depending on the circumstances of the marriage and the financial positions of both parties.

Temporary Support
Ordered during the divorce process to maintain the financial status quo while proceedings are pending. It typically ends once the divorce is finalized and a long-term arrangement is in place.

Rehabilitative Support
Time-limited support designed to give the lower-earning spouse time to gain education, job training, or employment, with the goal of eventual financial self-sufficiency.

Long-Term Support
May be awarded when the receiving spouse can’t reasonably become self-supporting due to age, health, or the length of the marriage. Courts may leave the termination date open-ended in these cases.

Lump-Sum Support
Replaces ongoing periodic payments with a single negotiated amount. This structure is often addressed as part of a marital settlement agreement and can offer certainty for both parties.

Duration of Spousal Support: The 10-Year Rule & the Rule of 65

For marriages under 10 years, California courts generally order support for approximately half the length of the marriage. That’s the typical starting point, though the specific facts of each case can shift the outcome.

For marriages of 10 years or longer, the court may set an open-ended termination date or decline to set one at all, preserving ongoing jurisdiction over the support obligation. The receiving spouse isn’t automatically entitled to permanent support, but the court has broader latitude to extend it.

An informal judicial guideline known as the Rule of 65 may also apply in appropriate cases. When the receiving spouse’s age and years of marriage combined equal or exceed 65, courts may factor in the financial hardship that terminating support could create, given that spouse’s reduced ability to become self-supporting. This isn’t a codified rule under California law, but it’s a recognized consideration in the right circumstances.

Spousal Support Modification & Termination

A spousal support order isn’t necessarily final. California courts can modify an existing order when there’s a material change in circumstances after the original order is entered. Significant income changes on either side, the paying spouse’s retirement, or the receiving spouse obtaining new employment can each support a motion to modify.

Termination is also possible in some situations. Under California Family Code Section 4337, support typically ends upon the receiving spouse’s remarriage. Cohabitation with a new partner may support a motion to reduce or end support, though it doesn’t automatically terminate the obligation. The court reviews the specific financial impact before making any change.
