Guiding Executors, Trustees & Heirs Through California Estate Settlement
Settling an estate in Carlsbad, California puts real responsibilities on real people. Whether you’ve been named executor in a will, appointed administrator by the court, or you’re a successor trustee or beneficiary trying to understand your role, the process carries legal deadlines, family dynamics, and paperwork that can feel overwhelming. At Lass Law, we provide strategic, easy-to-understand guidance so you can make informed decisions at every stage.
California probate is the court-supervised process of identifying a decedent’s assets, satisfying valid creditor claims and taxes, and distributing what remains to heirs or beneficiaries under the California Probate Code. When no executor is named in a will, the court appoints an administrator to fill that role. Either way, we handle every matter with care, consistency, and attention to detail so nothing falls through the cracks.
If you’re managing an estate in the Carlsbad area and aren’t sure where to start, call Lass Law at (760) 474-3861. We can walk you through your responsibilities and what to expect.

The California Probate Process, Step by Step
Understanding what happens and when helps executors and administrators stay ahead of deadlines. Most estates move through five core phases:
Filing the Petition
Administration begins by submitting a petition to the probate court, including the will if one exists and the required court forms.
Appointment of the Personal Representative
A Petition for Probate formally asks the court to appoint a personal representative. Once granted, the court issues letters testamentary if a will names an executor, or letters of administration if there is no will, authorizing that person to act on behalf of the estate.
Notice to Heirs & Creditors
The personal representative must notify all interested parties of the proceedings. Under California law, creditors generally have four months from when the court first issues letters to the personal representative, or 60 days from when they receive notice, whichever is later, to file claims against the estate.
Asset Management & Creditor Resolution
Valid debts and taxes are paid. Assets are inventoried and appraised. The personal representative manages estate property throughout this period.
Petition for Final Distribution
When administration nears completion, a Petition for Final Distribution is filed. Court approval distributes the remaining assets to heirs and formally closes the estate.
Where Carlsbad Probate Cases Are Filed
A common assumption is that a North County courthouse handles Carlsbad estates. It doesn’t. Probate matters originating in Carlsbad, CA are filed with the Central Division of the San Diego County Superior Court, located at the Central Courthouse in downtown San Diego. The Probate Division there oversees decedents’ estates, trusts, guardianships, and conservatorships for the entire county.
From filing to final distribution, Carlsbad probate cases typically take 9 to 18 months to resolve. The timeline depends on estate complexity, creditor claims, asset types, and whether any disputes arise among heirs.
Who We Assist
Most executors and administrators choose to work with an attorney to avoid costly mistakes, particularly when the estate includes real property or multiple heirs. We work with:
- Executors and administrators navigating court procedures and fiduciary duties for the first time
- Successor trustees administering a revocable living trust after the grantor’s death
- Out-of-state heirs who need to participate in California proceedings remotely through digital filings and virtual communication
- Beneficiaries who have questions about distributions or the status of an estate
This page covers uncontested estate administration. When disagreements escalate into formal disputes, we also provide probate litigation representation for contested estates in Carlsbad. That’s a separate engagement, and we can help you identify early whether your situation is heading in that direction.
