What Happens in California Without a Plan

Without any estate plan, California’s intestacy laws determine who receives your property. Those rules follow a fixed formula based on family relationships and don’t account for your actual wishes. If you have minor children, a judge who doesn’t know your family decides who raises them.

Probate is the court-supervised process of identifying a decedent’s assets, paying debts and taxes, and distributing what remains to heirs. In California, it applies to estates that meet a certain asset threshold and can take a year or longer to complete. A revocable living trust can help avoid it.

San Diego County Superior Court’s Probate Division handles decedents’ estates, trusts, guardianship of minors, and conservatorship matters. Probate filings are submitted at the Superior Court’s Central Division in San Diego. North County residents, including those in Carlsbad, can use a filing drop box at the Superior Court’s North County Division in Vista.

When to Update an Existing Will or Trust

An estate plan isn’t permanent. Life changes can make a previously well-drafted document work against your intentions.
